What Is the Living Space Ordinance?

The German Living Space Ordinance (WoFlV) has regulated the calculation of living space since 2004. It defines which rooms and proportional areas count toward living space. Accurate calculation is essential for rental agreements, utility cost statements, and compliance with rent control regulations. Both landlords and tenants should regularly verify the living space.

Understanding Counting Factors

Not all areas count fully toward living space. Rooms with sloped ceilings are counted proportionally based on headroom: areas below one meter do not count at all, those between one and two meters count at half. Balconies and terraces are typically counted at 25 percent, up to 50 percent for premium quality. Unheated conservatories are counted at 50 percent.

Living Space and Tenancy Law

Living space forms the basis for rent calculation. If the actual living space deviates by more than 10 percent from the area stated in the lease, the tenant may proportionally reduce the rent. Utility costs are also frequently allocated based on living space. Under rent control regulations, rent is assessed per square meter of living space.

Tips for Accurate Measurement

Measure each room at the interior walls at floor level. Niches and bay windows deeper than 13 centimeters count toward living space. Door openings and window sills are not included. For sloped ceilings, measure at multiple heights. When in doubt, a certified surveyor can determine the living space according to the WoFlV with binding authority.
